This Terms of Service Agreement is entered into between the Artist Shirouu_Kun and the Client for the commission of an artwork. By commissioning the Artist, the Client agrees to the following terms. The Artist retains all rights to the commissioned artwork.General
By purchasing my services (artwork drawn by me), you automatically agree to the following terms.
Commissions are for personal use only. Commercial rights require an additional charge of 100% of the original pricing.
By default, I retain copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to advertising, posting the work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more.
I reserve the right to decline any Client if I believe I will be unable to complete the requested commission for any reason.
Commissioned artwork is not allowed to be used for any form of AI or NFT.
Client is not allowed to edit, modify, or change commissioned artwork in any way.
Client is required to credit me (Shirouu_kun) if the commissioned artwork is to be used in any way.
If any term in the Terms of Service is broken by Client, I have the right to block, blacklist, and publicly post required information in order to warn others.I Can

Full payment must be sent and successfully received by me before the commission is started. The total price of the commission, including any additional fees, will be communicated to Client before payment agreed and is sent.
Additional fees include but not limited to commercial rights (100% additional commission price) and complex character design surcharge.
Once artwork has begun or payments have been made, the Client acknowledges artwork and deliverables are digital and there are no physically shipped goods to receive.Deadlines and Delivery
Commissions will take roughly 1 week to 3 months to complete each commission, however this timeline may change depending on my work schedule. Any updates or delays regarding my commission process will be announced on my twitter (@shirouu_kun) and/or on the front page of my Vgen page. Please be patient with me!
If the Client has a strict deadline for me to complete the commission, a specific deadline should be established before commission is accepted. If the Client requests for their commission to be put in Priority, there may be a Priority Commission surcharge discussed.
All commissioned files will be sent through Vgen. If there are any mistakes in the artwork, revised files will be sent through Vgen or email.Personal Use
Clients receive rights for the commissioned artwork for personal use.
Personal use means: display on social media accounts for promotional purposes with no direct monetization or sales, such as social media profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels; or any other instances where no monetization of, or of content featuring, the artwork is involved.
Client must not claim artwork as their own and must credit me using their social tag/username/link at the instance of display of the artwork or permanently on their websites, social media profiles, broadcast channels and so on where possible.Commercial Use
Commercial usage rights are not included in general commissions, unless specified in the commission type or project specifications listed on my websites (i.e. vtuber models, stream overlays, emotes, and so forth), or is purchased by the Client and agreed upon.
Commercial rights may differ for each commission type. Commercial broadcast rights means usage of Work on streams, videos, advertisements and other content, or any similar monetized instances; commercial distribution rights means selling or reselling Work to another party, as a part of any product or merchandising, or on another platform.
Usage of artwork for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.
Additional charges will be required for commercial usage if not included in the project type, listing, or specifications, typically 2x of the original cost.Refunds
Client agrees that they will not issue chargebacks and the refund policy mentioned below will be followed.
Refunds will only be considered and sent if commissioned artwork is not completed and sent by 3 months after the commission's accepted date.
I have the right to cancel and refund any commission request due to circumstances. If I am required to cancel the commission, a full refund will be sent to the Client.
Refunds are not allowed if commissioned artwork is in progress or completed. Refunding after the artwork is completed is strictly not allowed.Revisions and Communication
Client agrees that the commission process will include no check-ins or WIPs (work in progress).
The commissioned artwork will be sent through Vgen or email.
Revisions will only be made if there are mistakes made by me or if there are small coloring changes. Please make sure that your reference is clear and complete, or mistakes and changes will be denied if I believe the reference was unclear.
